Ibinasura ng Quezon City prosecutors ang reklamong grave na inihain ng isang kongresista laban kay dating Pangulong Rodrigo Duterte. Ayon sa piskalya, lumalabas na hindi napatunayan na seryoso ang sinabing pagbabanta.
Sa 14 na pahinang resolusyon ng QC Office of the City Prosecutor (OCP), inirekomenda nito na ibasura ang reklamo ni ACT Teachers party-list France Castro laban kay Duterte dahil sa kawalan ng sapat na ebidensiya upang iakyat sa korte ang reklamo.
“After a careful and judicious evaluation of the allegations and evidence obtaining in the complaint, the undersigned finds the same to be insufficient to indict respondents for the crime charged against him,” saad sa resolusyon.
Nag-ugat ang reklamo ni Castro noong Nobyembre dahil sa pahayag ni Duterte sa isang panayam sa Sonshine Media Network International (SMNI) na sinabi niya na: "Kayong mga komunista ang gusto kong patayin" at “Sabi ko sa kanya [Vice President Sara Duterte], magprangka ka na lang. Itong intelligence fund na ito gagamitin ko para sa utak ng mga Pilipino kasi ito ang target ko, kayong mga komunista andiyan sa Congress. Prangkahin mo na 'yan si France Castro."
Para sa piskalya na batay sa pagkakasabi at mga salitang ginamit ni Duterte, ang alegasyon ng pagbabanta ay hindi “convincingly establish that indeed respondent intended them to be taken seriously.”
“If the intention of the respondent was really to intimidate and to take seriously such threatening remarks/ statements… he would not have taken so much prologues and would have just directly and immediately pronounce the threats conceived in his mind,” saad pa sa resolusyon.
Sabi pa sa resolusyon, "unusual" kung hindi man “ridiculous” para sa isang tao na gawin o ihayag sa publiko ang pagbabanta sa buhay o pananakot.
Pinuna rin ng piskalya ang kabiguan ni Castro na makakuha ng authentication mula sa Facebook, YouTube, o SMNI tungkol sa video, post, o television broadcast ng nasabing panayam kay Duterte.
“Absent of any proper authentication, this Office cannot just take on its face value the genuineness and veracity of the subject threatening remarks/utterances/statements allegedly perpetrated by the respondent, most especially so that it constitutes so to speak the "corpus delicti" of the crime subject of the case,” paliwanag sa resolusyon.
“Without the necessary and proper authentication, there is no assurance that the afore-quoted threatening remarks and/or statements were correctly quoted or extracted from the original text/upload/post,” patuloy nito.
Sinabi naman ni Castro hindi pa sila nakatatanggap ng kopya ng resolusyon ng piskalya.—FRJ, GMA Integrated News
