Hinatulan ng Sandiganbayan na makulong at madiskuwalipika na humawak ng puwesto sa gobyerno si Surigao del Sur Representative Prospero Pichay Jr., dahil sa umano'y maanomalyang paglalagay niya ng P1.5 milyon pondo ng gobyerno sa National Chess Federation of the Philippines (NCFP).

Sa 31-pahinang desisyon ng anti-graft court na may petsang Oktubre 23, sinabing ang P1.5 milyon ay nagmula sa Local Water Utilities Administration (LWUA), na dating pinamumunuan ni Pichay noong 2010.

Nang panahon iyon, si Pichay din ang presidente ng NCFP, at acting chairman ng LWUA Board of Trustees (BOT)

Bilang parusa, hinatulan ng Sandiganbayan si Pichay at dalawa pang opisyal ng LWUA na makulong ng anim hanggang walong taon. Diniskuwalipika rin silang humawak ng posisyon sa gobyerno.

“Accused Pichay's claim that he was unaware of the budget for sponsorship of chess events as of the time when the LWUA-BOT deliberated on the 2010 Operating Budget deserves scant consideration. Such a claim contradicts his own statement that he saw no problem with the subject budget line item when he reviewed the proposed corporate operating budget,” saad sa desisyon.

Naniniwala ang anti-graft court na masusing pinag-aralan ni Pichay bilang LWUA-BOT Acting Chairman, ang pondong inilagay sa NCFP.

Kasama ni Pichay sa naturang kaso sina Emmanuel Malicdem (nakatalaga noon na LWUA Senior Deputy Administrator) at Wilfredo Feleo (nakatalaga noon na LWUA’s Acting Deputy Administrator for Investment and Financial Services).

“The prosecution was able to prove beyond reasonable doubt all the elements of violation of Section 3(e) of R.A. No. 3019 (Anti-Graft and Corrupt Practices Act) and that the accused acted in conspiracy with each other,” sabi pa sa desisyon.

“Accordingly, since in conspiracy the act of one becomes the act of all, the accused are to be held equally criminally liable,” dagdag nito.

Inatasan din ng korte si Pichay at dalawa pang kasama niya sa kaso na isauli sa LWUA ang P1.5 milyon na may kasamang tubo.

Hinatulan din ng Sandiganbayan na guilty si Pichay sa paglabag sa Code of Conduct for Public Officials and Employees dahil sa nasabi ring kaso.

Pinagmulta siya ng korte ng P5,000 para dito.— FRJ, GMA News
