Kinansela ng Intellectual Property Office (IPO) of the Philippines ang trademark registration ng Television and Production Exponents, Inc. (TAPE) para sa pangalang "Eat Bulaga" at "EB."
Sa 16 na pahinang desisyon ng IPO na inilabas nitong Martes, kinatigan nito ang petisyon nina Tito Sotto, Vic Sotto, at Joey de Leon, na sila ang tunay na may-ari ng "Eat Bulaga" trademark.
Ang desisyon ng IPO ay inilabas matapos na magbigay ng mga katibayan at testimonya ang panig ng TVJ tungkol sa pinagmulan ng pangalan ng show.
"It is not the application or the registration that confers ownership of a mark, but it is ownership of the mark that confers the right to registration," ayon sa IPO.
Sinabi naman ni TAPE Inc.'s legal counsel Atty. Maggie Garduque, na hindi pa nila natatanggap ang kopya ng desisyon.
"But if this is true, under the rules [TAPE] can appeal this decision to the director of the [Bureau of Legal Affairs] of IPO," sabi ni Garduque sa GMA News Online.
"If still unsatisfied with the decision of the director, they can still appeal it to the director general of the IPO," dagdag niya. "[TAPE] will avail of all legal actions/remedies to reverse this decision."
Nitong nakaraang Mayo 31, nang kumalas ang TVJ sa TAPE Inc., na producer ng "Eat Bulaga." Noong July, naghain ang TVJ ng copyright infringement complaint laban sa TAPE dahil sa paggamit ng "Eat Bulaga."
Paliwanag noong TAPE, sila ang nagrehistro ng tradename 'Eat Bulaga,' "so they cannot file infringement against the registered owner of the trademark." —FRJ, GMA Integrated News
