The Department of Justice (DOJ) has junked the 98 counts of reckless imprudence resulting in homicide case filed against former Health Secretary Janette Garin, the incumbent representative of the First District of Iloilo, and others accused in relation to the Dengvaxia (dengue vaccine) issue.

In a resolution, the DOJ ordered the prosecutor general to recall the case filed before the Regional Trial Court in Quezon City. It was established that there is no prima facie case with reasonable certainty of conviction against the respondent.

DOJ said that the respondent is not culpable as she reportedly did not bear bad or malicious intention in carrying out her job.

Further, it was not established that the death of a certain number of children was connected directly to the Dengvaxia vaccination, which is the content of the complaint affidavit of complainants.

Garin is glad that the case is dropped.

“We are very happy. I believe matagal na ito. This has been a long-awaited justice para sa mga doctor, sa mga scientist, at sa mga eksperto. Malinaw naman na napolitika ang kalusugan ng tao. Public health was politicized,” Garin said.

GMA Regional TV One Western Visayas tried to seek a comment from the Public Attorney’s Office that initiated the filing of the case.

However, no one accepted the call in all the contact numbers provided.
