Cebu road rage victim provides photos of incident


A photo provided by the camp of the road rage victim in Cebu City shows he only had one companion at the time of the shooting, GMA News' Emil Sumangil reported on "24 Oras."

The picture was taken moments before Ephraim Nuñal was shot by David Lim Jr. as seen in a video that went viral, said lawyer Mundlyn Misal Martin, Nuñal's lawyer.

Martin said the photo disputes the claim of Lim's lawyer, Jun Salatandre, that the road rage suspect shot Nuñal in self-defense and that the video posted online was edited.

Martin added that, "My client came from work, may kasama siyang dalawa. Yung isa nadrop off na niya so meron siyang isang kasama na supposedly 'yun ang kasunod na idrop off niya. Dalawa lang silang sakay." 

The claim of the victim's lawyer is different from that of Salatandre, who said on Tuesday that his client felt threatened upon seeing Nuñal had companions which prompted Lim to flee afer firing a warning shot which was done in self defense.

Atty. Martin gave GMA News a copy of a photo that shows Lim's Mercedes Benz after it suddenly stopped in the middle of F. Sotto Street in Barangay Kamputhaw.

"Iisa lang ang road, so siya yung nakasunod hindi siya makapag-overtake kasi nasa gitna siya,  si David. Normal reaction you honk, para tumabi siya. Hindi siya tumabi," Martin said. 

Martin did not say where the pictures came from, but she said it was taken before Lim fled the scene. 

Lim, meanwhile, explained on Tuesday that Nuñal kept on honking at him.

"They know from the very beginning that i wasn't driving zigzag. They kept honking more than five seconds, honking. The two cars kept honking at my back," Lim said, adding that the video uploaded on social media was edited. 

"When I went down the car he kept shouting at me pa, so we got into a fistfight and when I saw his male companions, they were more than 1, 2.. i don't know. Basta there were male companions who went down the car. That's when i felt threatened," Lim said. 

"I fired a warning shot on the ground as you can see in the video. He directly went to me so I just had to restrain him before he could get the gun from me. I don't know what he might do," he added. 

Martin underscored the video was the raw version and was not edited. 

On Wednesday, Lim's camp announced that a P300,000-reward will be given to anyone who can present the unedited version of the viral video.

Lim remains detained at the headquarters of the Police Regional Office 7 as his lawyer was still unable to post bail because the resolution has not yet been signed by the fiscal assigned to the case.
