Residents of Delfin Lee's Xevera project sue Pag-IBIG for foreclosing on homes
Some homeowners at Xevera subdivision in Bacolor, Pampanga are suing the Pag-IBIG Fund for foreclosing on their houses in the Globe Asiatique development.
According to a "24 Oras" report aired Sunday evening, residents say that Pag-IBIG Fund does not have a right to foreclose on their homes even though they have stopped making payments on home loans from Pag-IBIG.
They have filed a case at a San Fernando, Pampanga court, the report said.
Homeowners say their unpaid housing loans are covered by a memorandum of agreement between Pag-IBIG and Globe Asiatique that Pag-IBIG "unilaterally" terminated.
"May guarantee si (Globe Asiatique founder) Delfin Lee na...limang taon, babayaran niya yung utang mo sa Pag-IBIG. In fact, may P600 million – almost P600 million – na pondo si Delfin Lee na nasa Pag-IBIG," Remon Recto, vice president of the Xevera Homeowners' Association, said.
He said a Makati City court has ruled that the money can be used to cover unpaid housing loans.
But Pag-IBIG Fund said it is only following guidelines by foreclosing on homes owned by members who have not been making payments on their loans.
"Meron po kasi silang sinasabi na dapat po ay hindi namin pinutol ang MOA. Eh, ngayon, natuklasan namin, ang daming bogus borrowers, ang daming double sale. Eh, bakit po namin itutuloy yan?" Joan De Venecia, Pag-IBIG vice president for public affairs, said in the report.
Pag-IBIG added more than half of the homeowners at Xevera have been paying off their housing loans.
De Venecia said residents should instead file cases against Delfin Lee and Globe Asiatique.
Lee is currently being held at the Pampanga provincial jail in San Fernando City on a syndicated estafa case for allegedly using ineligible members, members with incomplete documents, and non-existent borrowers to secure housing loans from the Pag-IBIG Fund. — JDS, GMA News
