DOLE: Work permit required for children under 15 in online content

The Department of Labor and Employment (DOLE) has issued an advisory requiring children under 15 years old to secure a work permit before participating in public entertainment or information projects, including content on social media platforms.

Under Labor Advisory No. 12, series of 2026, DOLE reminded the public that children under 15 years of age are generally prohibited from working under Republic Act No. 9231, or the Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act.

“Exceptions are allowed only when the child works directly under the sole responsibility of a parent or legal guardian and only family members are employed, or when the child’s participation in public entertainment or information is essential,” DOLE said in a press statement.

In both cases, a work permit from the agency is required before the child can work, according to DOLE.

The agency’s new guidelines define engagement in “public entertainment or information” as covering artistic, literary, and cultural performances and productions distributed through television, radio, cinema, theater, print, and the internet.

“It also includes content published through streaming platforms, social media, vlogs, digital advertisements, web series, podcasts, educational content, and other emerging forms of media,” DOLE said.

“Children below 15 who participate in content creation for online posting may need a working child permit if the child or the activity falls within the coverage of the Department’s existing guidelines on working children,” it added.

DOLE’s advisory holds parents or legal guardians accountable for ensuring compliance with the advisory and the law.

The Labor Department also reminded employers to strictly comply with the provisions of R.A. 9231, particularly safeguards against child labor, restrictions on children's participation in certain advertisements, limits on working hours, rules on a working child's income, and measures protecting their access to education, training, and other essential services.

The department advised the public to report suspected violations to DOLE or other authorities for proper investigation and action. — RSJ, GMA News
