Sandro Muhlach’s rape complaint vs. contractors filed for resolution

The rape complaint filed by Actor Sandro Muhlach against two independent television contractors has been submitted for resolution, a lawyer said Thursday.

Muhlach had filed a complaint for rape through sexual assault and acts of lasciviousness against Jojo Nones and Richard Cruz before the Department of Justice (DOJ) in August.

“Submitted na po for resolution ang kaso (the case has been submitted for resolution),” Maggie Garduque, the lawyer of Nones and Cruz, said in an ambush interview following the preliminary investigation.

This was confirmed by the DOJ.

Muhlach, Nones, and Cruz personally attended the preliminary investigation.

This is the first time that the three met in person since the incident. The two respondents were later escorted to a different room.

Niño Muhlach said that Sandro had cried after the meeting.

“Nagalit syempre. Umiyak siya sa loob. So pinalabas muna yung kabila,” he said in an ambush interview after the preliminary probe.

(He was angry. He cried inside. So the other camp was made to go out.)

Meanwhile, Garduque said they submitted a counter-affidavit on the complaint, where they denied the allegations against them.

In their counter-affidavit, Nones and Cruz asked the DOJ to dismiss the complaint of rape through sexual assault and acts of lasciviousness against them.

“Pinapabulaanan po namin ‘yung alegasyon ng rape through sexual assault na binibintang sa kliyente po namin,” Atty. Maggie Garduque said in an ambush interview.

For Garduque, the allegations were not supported by documentary evidence. She denied that Muhlach was drugged, saying that he tested negative for a drug test.

Nones and Cruz previously denied that they sexually assaulted Muhlach. They also appealed to the public not to "crucify them like convicted criminals."

Meanwhile, aside from the complaint, Muhlach also filed a formal complaint against Nones and Cruz before the human resources of GMA Network, prompting it to conduct its own investigation.

GMA Network Senior Vice President for Programming, Talent Management, Worldwide, and Support Group Atty. Annette Gozon-Valdes said GMA has suspended the two independent contracts while the probe is ongoing.
