PFP appeals junking of its intervention on petition to cancel Marcos’ COC


The Partido Federal ng Pilipinas (PFP) on Monday partially appealed the Commission on Elections’ (Comelec) junking of the interventions which they filed related to the petition seeking to cancel the certificate of candidacy (COC) of their standard-bearer former Senator Ferdinand “Bongbong” Marcos Jr.

The motion for partial reconsideration was filed by intervenors Reynaldo S. Tamayo Jr., Victor D. Rodriguez, and Thompson Lantion on Monday, the last day for petitioners and respondents' filing of their respective memoranda.

According to a tweet by GMA News’ Tina Panganiban-Perez, PFP intervenors prayed that the Comelec's Second Division would reconsider last week's order which denied all the interventions filed by both camps seeking to boost their respective arguments.

“Wherefore, it is respectfully prayed that this honorable Commission reconsider its Order dated 13 December 021 and grant the motion to intervene and admit the attached answer-in-intervention,” the PFP intervenors motion read.

Before the filing of the motion, Comelec spokesperson James Jimenez disclosed that the petitioners on the case had already filed their memoranda.

“The biggest update that we have is yung kay Buenafe versus Marcos kung saan nag-file ng (where they filed the) memoranda ‘yung petitioner because today is the deadline,” he said.

In their memorandum, the petitioners argued that Marcos’ COC should be canceled because of the material representation that the presidential aspirant made.

 

 

They argued that Marcos’ representation that he is eligible and not disqualified to run for public office is “false” as he was convicted by final judgment for violating the National Internal Revenue Code, which “automatically and ipso facto carries a penalty of perpetual disqualification from holding any public office, to vote and participate in any election.”

Petitioners also asked the Comelec to exclude the name of Marcos from the list of official candidates for president on the official ballot for Eleksyon 2022.

The Comelec also confirmed this afternoon that the Marcos camp had submitted their memorandum.

On December 13, the Comelec ordered both parties to file their respective memoranda within five days, after which the petition would be up for resolution.

“The parties are hereby given a period of five days from receipt of this Order to file their respective Memoranda in accordance with COMELEC Resolution No. 10673,” the Comelec Second Division’s order dated December 13 read.

“This case is deemed submitted for resolution after the lapse of the said period.”

The petition being resolved was filed by Fr. Christian Buenafe, co-chairperson of Task Force Detainees; Fides Lim, board chair of Kapatid-Families and Friends of Political Prisoners; Ma. Edeliza Hernandez, executive director of the Medical Action Groupl Celia Lagman Sevilla, secretary general of the Families of Victims of Involuntary Disappearance; Roland Vibal Philippine Alliance of Human Rights Advocates , and Josephine Lascano, executive director of the Balay Rehabilitation Center.

The groups are seeking the cancellation of Marcos’ COC for president, arguing that the latter was convicted on July 27, 1995 for failure to file income tax returns several times from 1982 to 1985.

They said this made Marcos, son and namesake of the late dictator Ferdinand Marcos Sr., ineligible to run for office because he was a "convicted criminal."
