Robin Padilla files online libel complaint versus netizen Ms. Krizzy

Actor Robin Padilla has filed a case against netizen Miss Krizzy (@krizzy_kalerqui), a Twitter user who negatively reacted against a photo on the actor's Instagram page on the day of the elections.

In the complaint tweeted by DZBB reporter Tuesday Niu , law firm Jurado Jurado & Associates stated that the actor could not have possessed the ballot for which he was criticized for as he was not a registered voter.

"Please note that our client is NOT a registered voter due to complications brought about by his prior conviction. As such, he could neither possess/acquire an official ballot nor enter a voting precinct," the complaint stated.

"It is, therefore, legally impossible for our client to perpetrate the alleged election offense (i.e., taking a photograph of his filled-up official ballot inside a voting precinct)," it continued.

Padilla filed charges of online defamation and online libel against Ms. Krizzy with the National Bureau of Investigation (NBI) through Atty. Rudolf Jurado on Thursday.

Ms. Krizzy was among the legion of netizens who flooded Padilla's social media accounts with negative comments after the actor supposedly posted a picture of a shaded ballot on his Instagram page.

The netizen tweeted: "This is a clear violation of election law! Throw him in jail as well. NO ONE IS ABOVE THE LAW! #Halalan2016 pic.twitter.com/QqoGZlURcZ"

It was followed by: "@regietdc He deleted it after his attention was called!"

Both tweets have since been deleted.

The picture of the shaded ballot was immediately deleted. It was eventually replaced with a statement from Jurado, which reiterated that Padilla was "legally barred to exercise his right to vote."

Padilla then posted on his Instagram that he was "not tolerating the present assassination of my character. My honor is the only thing that I have in my life."

The actor also called on the Commission on Elections to arrest him if it is proven that he posted a picture of a shaded official ballot on his social media account. —Rie Takumi/NB, GMA News
