Graft charges filed against Napoles, Enrile, Estrada, Revilla at Sandiganbayan


(Updated 6:29 p.m.) Aside from plunder, alleged pork barrel scam mastermind Janet Lim-Napoles and Senators Juan Ponce Enrile, Jinggoy Estrada and Ramon Revilla Jr now also face graft charges in connection with the alleged misuse of their Priority Development Assistance Fund (PDAF), a television report said Monday.

GMA News TV's "QRT" reported that he Office of the Ombudsman filed 15 counts of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act against Enrile, 16 counts against Revilla and 11 counts against Estrada on Monday afternoon.



That provision of the anti-graft law penalizes "causing any undue injury to any party, including the Government, or giving any private party any unwarranted benefits, advantage or preference in the discharge of his official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence."

Also charged with graft were John Raymund de Asis, driver and bodyguard to Napoles who was made president of Countrywide Agri and Rural Economic Development Foundation, Inc; Revilla's former chief of staff Richard Cambe, Budget Undersecretary Mario Relampagos and Technology Resource Center Director Dennis Cunanan.

De Asis and Cambe were among those charged with plunder Friday, together with Napoles, Enrile, Estrada and Revilla.

The filing of graft charges against other personalities allegedly involved in the pork barrel scam will be continued Tuesday.

Plunder is a non-bailable offense. It is punishableby 30 years in prison and the forfeiture of ill-gotten wealth in favor of the government.

Graft, on the other hand, is punishable by imprisonment of not less than six years and one month to 15 years, perpetual disqualification from public office and confiscation or forfeiture in favor of the government of any prohibited interest and unexplained wealth. — Amita Legaspi/ JDS, GMA News
