ER Ejercito has until Tuesday to get TRO—Comelec


Laguna Gov. ER Ejercito has until Tuesday, May 27, to secure a temporary restraining order from the Supreme Court against the Commission on Election's decision disqualifying him from office due to campaign overspending in 2013.
 
Comelec chair Sixto Brillantes, Jr., made the remark after Ejercito on Friday asked the Supreme Court to nullify the Comelec's ruling on his disqualification. Ejercito asked for a TRO from the court to prevent the implementation of the Comelec order while the High Tribunal tackles his case.
 
“If there is no TRO by Monday, then the SC will meet the next day (Tuesday). We can still wait for it. Meaning, if they secure a TRO by Tuesday, it’s acceptable…. He won’t be removed from office,” Brillantes said.
 
“We are not unreasonable,” he added.
 
Brillantes, however, said the decision of the Comelec disqualifying the Laguna governor will already be executory if the Supreme Court doesn't issue any TRO.
 
“By Wednesday or Thursday, (if there is no TRO), we will already have the decision sent to the Department of Interior and Local Government (DILG) for implementation,” Brillantes said.
 
Vice Gov. Ramil Hernandez will take over as governor once the Comelec decision is implemented. —NB, GMA News
