Rap dropped vs motorist who hit counterflowing rider on SLEX
The complaint filed against the driver of the Asian utility vehicle (AUV) involved in the crash that killed a motorcyclist at the Skyway Stage 3 were dropped, according to Highway Patrol Group-SLEX-Sub-Office chief Police Captain Jun Cornelio Estrellan.
“May proseso po tayong sinusunod [dahil] may patay po sa insidente. Automatic po yun, kung sino po yung nakapatay ng tao eventually po yun po yung mafafilan ng kaso. Iproproseso naman po yun tapos eventually ifa-file sa Prosecutor’s Office kung saan nangyari yung pangyayari,” said Estrella.
(We have to follow a process because someone died in the incident. It's automatic, a case would be filed against whoever killed a person. We'll process that, and then eventually file that with the Prosecutor's Office where it occurred)
He added that the driver would not face any further complaints and that a release order was being processed as of Tuesday afternoon.
“Natanggap na po namin ang resolusyon na nagpapatunay na yung driver po ng [AUV] ay walang liability pagdating po sa pangyayari. So pinalaya na po yung ating driver ng [AUV]. Wala na po [mangyayari] sa kanya,” he added.
(We've received the resolution proving that the driver of the AUV has no liability in the incident. So, we released the driver of the AUV. Nothing will happen to him.)
Meanwhile, the PNP-HPG did not comment on possible liabilities the Skyway's management may face because of the incident.
“Ang part po ng HPG sa matter to investigate kung ano man po ang pangyayari. Tapos na po yung part ng PNP [at] ng HPG,” he said.
(The HPG's part in the matter is to investigate whatever happened. The PNP and HPG completed its role in the matter.)
On Monday, a rider drove his motorcycle against the traffic flow along the Balintawak portion of the Skyway Stage 3.
Further investigation found that the rider had no helmet and license, was traveling at 80 kilometers per hour, and was intoxicated at the time of the crash.
He was also using a 150cc motorcycle, which was not allowed along the Skyway.
