
"That's not true!" pagdidiin ng kampo ni Nadia Montenegro sa "attempted kidnapping" complaint ni Annabelle Rama laban sa kanila. Noong December 13 nagsumite ng complaint-affidavit si Annabelle sa Quezon City Prosecutor's Office, kung saan inilagay ang pangalan ni Nadia, ang abugado nitong si Atty. Marie Glen Abraham, at lima pa nilang kasama bilang respondent. Sa pakikipagpalitan ng text ng PEP.ph (Philippine Entertainment Portal) kay Atty. Abraham ngayong Sabado, December 17, bandang 10:46 ng umaga, kinuwestiyon ng abugado ang naging basehan ng reklamo ni Annabelle. Sinabi rin nitong naaayon sa batas ang kanilang ginawang pagpunta sa opisina ng Royal Artists Management sa Imperial Palace Suites noong December 6. Aniya, "Is that the basis of the attempted kidnapping case? "Even a non-lawyer would know that said acts did not constitute the crime of kidnapping. "With media and the police, paano naman magiging kidnapping yun? "We acted under the purview of Section 5, Rule 113 in relation to Section 7 Rule 112 of the revised rules on criminal procedure." Ayon sa Supreme Court E-Library, ang nakapaloob sa Section 5, Rule 113, ay: "A peace officer or a private person may, without a warrant, arrest a person: "(a) When, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense; "(b) When an offense has just been committed and he has probable cause to believe based on personal knowledge of facts or circumstances that the person to be arrested has committed it; and "(c) When the person to be arrested is a prisoner who has escaped from a penal establishment or place where he is serving final judgment or is temporarily confined while his case is pending, or has escaped while being transferred from one confinement to another. "In cases falling under paragraphs (a) and (b) above, the person arrested without a warrant shall be forthwith delivered to the nearest police station or jail and shall be proceeded against in accordance with section 7 of Rule 112. (5a)" Ang dagdag paliwanag ni Atty. Abraham sa text: "Under said rules, a peace officer or a private person may, without a warrant, arrest a person when, in his presence, the person to be arrested has committed, is actually committing or is attempting to commit an offense. "When Ms. Annabelle had an outburst during the December 6 hearing, she was committing an offense of grave oral defamation, et. al., in the presence of Nadia and other witnesses." Ang sinasabi ni Atty. Abraham na "outburst" ni Annabelle noong Disyembre 6 ay ang ginawang paninigaw at tangkang pananakit di umano nito sa kanyang kliente na si Nadia Montenegro, sa clarificatory hearing na naganap ng araw na iyon. Kuwento ni Atty. Abraham, matapos ang insidente ay hinanap na nila ang talent manager para sampahan ng reklamo. Nang hindi nila ito nahanap, humingi sila ng tulong sa pinakamalapit na istasyon ng pulis upang masailalim ito sa isang inquest. Ang "inquest," ayon sa thefreedictionary.com, ay isang "judicial inquiry." "Immediately after the hearing we, looked for her but she left the hall of justice already," saad ng abugado ni Nadia. "Nadia proceeded to the nearest police station to ask for police assistance to effect her arrest, and if she was taken she can be subjected to inquest. "Dahil grave oral defamation yun, she has a period of eight hours para ma-inquest. "However, when we went to Ms. Annabelle's office, wala siya dun, until the period lapsed. "Thus, the case was filed under the regular preliminary investigation na lang at di na inquest. "For the record, Nadia already filed a case for grave oral defamation, slander by deed, attempted physical injuries and unjust vexation against Ms. Annabelle Rama with regard to said incident last week."
"A DESPERATE ATTEMPT." Samantala, itinanggi rin ni Atty. Abraham na may kasama silang "representative" mula sa Quezon City Prosecutor's Office. Wala raw ganoon. Ayon kasi sa salaysay ng isang witness ni Annabelle, na si Nelson Canlas, reporter mula sa GMA-7, ay mayroon siyang tinanong na isang kasama ng grupo na naka-civilian na damit at nagpakilala bilang kinatawan ng nasabing tanggapan. Heto ang salaysay sa complaint affidavit ni Annabelle: "Seeking answers, Mr. Canlas turned to the older man in civilian clothes and inquired if he is a policeman. "He then introduced himself as a representative from the Quezon City Prosecutor's Office. "Thereafter, Mr. Canlas asked him if he has a warrant of arrest or any form of writing that they can legally make me go with them. "Respondent John Doe, a representative of the Prosecutor's Office, explained that they are just there to invite me [Annabelle], and avoided his question." Wala pang natatanggap na kopya si Atty. Abraham ng complaint-affidavit ni Annabelle, pero noong nalaman niya ang tungkol dito, ang sabi nito: "Natawa nga ako dun, e." Muli, iginiit niyang, "That's not true." Dinenay niya na may kasama sila mula sa nasabing tanggapan. "Walang taga prosecutor's office. Yung sinasabi nila, isa yun sa witness namin and he is not even an employee of City Hall. "I hope they verified facts first before they do such accusation. "I was there, Nadia, the policemen who assisted us, and our two witnesses. "Kung natuloy kasi inquest noon, kailangan na present na ang witnesses."
KONEKSYON. Sinagot din ni Atty. Abraham ang akusasyon ni Annabelle na maraming koneksyon ang kanyang kliente kaya hihiling ang talent manager ng "change of venue" sa lalong madaling panahon. Ang reaksiyon ng abugado ni Nadia sa text: "We already filed our vehement opposition thereto as the claim of bias and partiality of the whole city prosecutor's office to our cases are baseless and purely imaginary." Sa huli, nagbigay ng mensahe si Atty. Abraham sa kampo ni Annabelle Rama: "I believe this case is a desperate attempt to find a leverage case sa mga cases that Nadia filed against Annabelle. "Albeit, this will not stop or scare Nadia from proceeding with her cases against Ms. Rama." Bukas ang PEP sa magiging reaksiyon ng kampo ni Annabelle Ramasa sa isyu. --
