Archie Alemania indicted for acts of lasciviousness in Rita Daniela complaint

The Office of the City Prosecutor in Bacoor City has indicted actor Archie Alemania for acts of lasciviousness following the complaint filed by actress Rita Daniela in October 2024.

The prosecutor’s office found “prima facie case with reasonable certainty of conviction to indict respondent Arthur V. Alemania Jr. a.k.a Archibald Nicholas Alemania a.k.a Archie Alemania of the crime of Acts of Lasciviousness.”

The prosecution also recommended that Alemania be penalized under Article 336 of the Revised Penal Code.

Daniela had alleged in her complaint-affidavit that Alemania kissed and touched her without consent and repeatedly made inappropriate remarks against her.

“In this case, complainant was able to show how respondent touched forcibly kissed her and groped her breast and mashed it maliciously while they were inside respondent’s vehicle, which showed lewd signs on his part,” the resolution read.

Further, the prosecutor’s office pointed out that Alemania’s denial of the allegations against him are insufficient to overturn the findings on him.

“Furthermore, respondent’s allegation that he was only joking and was only being funny and that he did not do anything to complainant was not supported by evidence. Respondent’s bare denial of the allegations against him is insufficient to overturn the findings against him,” the resolution read. “It is well-established that denial is an inherently weak defense.”

Daniela earlier said the incident happened after a Thanksgiving party in September. During the party, Alemania already made obscene remarks towards her.

Daniela said that while waiting for her Grab after the party, the actor while onboard a white van stopped in front of her and offered her a ride home.

She added that she initially refused his offer but was persuaded by Alemania as she thought he was already sober.

Daniela also said that Alemania kissed her without her consent and struggled against him.

She attempted to get out of the vehicle but Daniela said that he hugged her from behind and touched her.

Daniela said she started to cry and used all of her strength to get out of his grip and get out of the car.

GMA News Online is trying to reach out to Alemania’s camp for a comment.

It can be recalled that Alemania submitted a counter-affidavit last December in response to the complaint filed by Daniela. 

The actor and his lawyer Atty. Ameir Muksan submitted the document at the Bacoor Hall of Justice. 

They declined to give a comment, but the prosecutor said the counter-affidavit denies the allegations Daniela previously made. — BAP, GMA Integrated News
