Neri Naig released from detention - BJMP
Neri Naig has been released from detention around 6 p.m. on Wednesday, the Bureau of Jail Management and Penology confirmed.
According to a report on "24 Oras," the court order for her release was served at the undisclosed hospital where she underwent medical evaluation.
Naig was arrested on November 23 for charges of syndicated estafa and violation of the Securities Regulation Code.
Her camp filed a motion to quash against her warrant of arrest, arguing that the actress was not notified of the allegations against her.
The Pasay City Regional Trial Court granted the motion on Wednesday and directed the Office of the Prosecutor to reinvestigate the case.
As seen in Jun Veneracion's report on "24 Oras," court documents reveal that Naig was issued a subpoena by the prosecutor's office, but it was delivered to the wrong address.
"The lack of proper notice to accused Miranda in flagrant violation of her constitutional right to due process of law invalidates the preliminary investigation conducted by the OCP-Pasay City," the court said.
Meanwhile, the court denied Naig's motion to withdraw information of the case.
"The facts remain na ganun pa rin naman 'yung kaso. Kaya po nindi ninullify ng judge 'yung information na kanyang binigay base po doon sa resolution ng piskal," said Atty. Roberto Labe, the legal counsel of the complainants.
In a statement released earlier, Naig's camp welcomed the court order for her release and expressed hope that the reinvestigation will clear her of wrongdoing.
"We appreciate the Court's decision, which underscores Neri's constitutional right to due process. The reinvestigation will provide an opportunity for Neri to respond to the allegations against her," said her legal counsel Atty. Aureli Sinsuat.
The actress was an endorser and franchisee of Dermacare - Beyond Skin Care Solutions, which is also facing a case for alleged violation of the Securities Regulation Code.
In September 2023, the Securities and Exchange Commission (SEC) released an advisory against the company, saying that it is not authorized to solicit investments because it is not registered and has no license to sell securities.
The commission also said that salesmen, brokers, dealers, agents, promoters, influencers, and endorsers of Dermacare may be sued.
On September 1, 2023, Naig announced on social media that she is no longer affiliated with Dermacare and any transaction using her name is not authorized or was done without her permission.
