QC court asked to junk Gabby Concepcion, Jobert Sucaldito settlement


MANILA, Philippines - Talent manager Rose Flaminiano has asked the Quezon City regional trial court to junk the joint motion to dismiss the P2.8-million damage suit filed against her and her former ward, actor Gabby Concepcion, by entertainment columnist Jobert Sucaldito. Flamiano said the joint motion to dismiss filed by Sucaldito and Concepcion is not only improper but also a flagrant violation of the provisions of Section 7 Rule 3 of the Rules of Court. Flaminiano’s request was contained in a comment and rejoinder filed through her legal counsel, Eduardo Flaminiano, before the sala of QCRTC Branch 96 Presiding Judge Afable Cajigal. Sucaldito filed the damage suit against Concepcion and Flamiano after they allegedly reneged on an agreement. He however later entered into a settlement with the actor. Sucaldito and Concepcion, through their respective lawyers, filed the joint motion to dismiss last Sept. 22 asking the court to dismiss the civil case against the actor, leaving Flamiano as the sole respondent in the suit. Cajigal has set the pre-trial of the case filed by Sucaldito on Nov. 7. The relationship between Flaminiano and Concepcion turned sour when the actor terminated his management contract over financial issues. The legality of the contract’s termination is now the subject of litigation at the sala of QCRTC Branch 97 Bernelito Fernandez after Flaminiano filed the petition asking the court to restrain Concepcion from rescinding his management contract with her. - GMANews.TV
