Neri Naig files motion to quash; arraignment moved to January 9
Neri Naig has been brought back to the Pasay City Jail's female dormitory after her supposed arraignment on Thursday at the Pasay Regional Trial Court was moved to January 9.
According to Oscar Oida's report on "24 Oras," Thursday, RTC Branch 111 staff said that the arraignment for her alleged violation of the securities regulation code was moved after Neri's camp filed a motion to quash.
The court asked the prosecution and the Securities and Exchange Commission (SEC) to submit comments regarding the motion.
Neri's camp declined to give a statement.
She was arrested at a basement convention center inside a mall in Pasay City on November 23.
Neri is also facing an estafa case in relation to Presidential Decree 1689, which increases penalty for estafa "committed by a syndicate consisting of five or more persons formed with the intention of carrying out the unlawful or illegal act, transaction, enterprise or scheme."
In a social media post, Neri's husband, Chito Miranda, defended her, saying she was only an endorser and her face was used to get investors.
The OPM singer also said his wife did not receive any notice that she is facing a criminal complaint.
"Wala siyang na-receive na letter from the prosecutor, walang subpoena, walang kahit anong notice," he said. "Anyway, dinampot na lang siya bigla."
Celebrities expressed support for the couple, including Chito's uncle Kiko Pangilinan, who offered legal help.
