Itinuturing ng abogado ni Rita Daniela na "mere affirmation" o pagkumpirma ang laman ng counter-affidavit na isinumite ni Archie Alemania sa piskalya kaugnay sa isinampa nilang reklamo na act of lasciviousness laban sa aktor.
Sa pahayag na ipinadala ng abogado ni Rita na si Atty. Maggie Abraham-Garduque sa "Fast Talk With Boy Abunda," inihayag nito na mistulang inamin ni Alemania ang mga mahahalay na salita na sinabi nito sa kaniyang kliyente.

"He also admitted that while in the car, he touched Rita. Albeit, he said that he uttered those words because he was just being wacky and he made the touches to comfort her, this does not erase the fact that he did the acts complained of," saad ni Abraham-Garduque.
"He also said in his counter affidavit that when Rita got out of his vehicle, she was very angry. Why would Rita be angry when he did not do something wrong when they were at the car? If he just touched to comfort her?," pahayag pa ng abogado.
Idinagdag pa ni Abraham-Garduque, na maituturing na "material admissions" ang naturang mga pahayag ng aktor na nagbibigay ng "reasonable certainty of conviction" para kasuhan si Alemania ng acts of lasciviousness.
Ayon kay Tito Boy, nakikipag-ugnayan ang "Fast Talk" kay Alemania para makuha ang panig nito pero hindi pa tumutugon habang isinusulat ito.
