Dismayado ang Department of Justice (DOJ) sa naging pasya ng Timor-Leste Court of Appeal na tanggihan ang extradition request ng Pilipinas para mapauwi sa bansa si dating Negros Oriental Representative Arnolfo “Arnie” Teves Jr., na nahaharap sa multiple murder cases.
Ikinagulat ng DOJ ang naturang desisyon dahil dalawang beses nang kinatigan ng kanilang korte ang extradition bago ang mga ginawang apela ng kampo ni Teves.
“It is peculiar that after having twice decided in favor of extradition—first in June 2024 and again in December 2024—the Timor-Leste Court of Appeal has now reversed its stance, taking a complete 180-degree turn to reject the Philippines' extradition request,” ayon sa DOJ.
Unang inaprubahan ng korte ang extradition request noong June 2024, pero kinuwestiyon ng kampo ni Teves ang proseso kaya muling nagsagawa ng pagdinig.
Noong December 2024, naglabas muli ng desisyon ang korte na pabor pa rin na ibalik ang dating kongresista sa Pilipinas, at humirit muli ng apela ang kampo ni Teves.
“This sudden shift raises serious concerns, and we are currently seeking further clarification regarding the basis of this decision,” ayon sa DOJ, na hindi pa umano nakakatanggap ng opisyal na kopya ng bagong desisyon ng CA ng Timor-Leste.
Ikinatuwa naman ni Atty. Ferdinand Topacio, ang desisyon na pabor sa kaniyang kliyente na si Teves, na tinawag niyang “triumph of the rule of law.”
"The decision… denying the request for extradition of Rep. Arnolfo Teves to the Philippines to face trumped up charges fabricated by the oppressive and dictatorial Marcos government, is a triumph of the rule of law, and an indictment of the kind of government we currently have,” saad ni Teves sa isang pahayag.
“A government who ignores the Constitution and the laws of the Republic in the brazen desire to silence political dissent and destroy the legitimate political opposition,” dagdag nito.
Ayon naman sa DOJ, ang kahilingan na iuwi sa bansa si Teves ay “matter of justice” at hindi lang “merely a legal issue.”
“Mr. Teves is facing serious charges, including multiple counts of murder, and must be brought home to face the full force of the law,” giit ng DOJ.
“Allowing him to evade justice would be the height of injustice, not only to the victims and their families but to the integrity of the rule of law,” dagdag nito.
Susuriin umano ng DOJ ang naging desisyon ng korte ng Timor-Leste para sa kanilang susunod na legal na hakbang para maibalik sa bansa si Teves.
Nahaharap sa mga kasong pagpatay si Teves, kabilang ang nangyaring pagsalakay sa bahay at pagpatay kay dating Negros Oriental governor Roel Degamo at iba pa noong March 2023.
