Cedric Lee, Deniece Cornejo at iba pa, hinatulang guilty ng korte dahil sa illegal detention

Hinatulang guilty ang negosyanteng si Cedric Lee at tatlong iba ng isang korte sa Taguig dahil sa ilegal na pagdetine sa TV host at aktor na si Vhong Navarro noong 2014.

Sa 94-page desisyon ng Taguig Regional Trial Court (RTC) Branch 153 ito, hinatulan nito sina Lee, Deniece Cornejo, Ferdinand Guerrero, at Simeon Raz na guilty “beyond reasonable doubt” ng serious illegal detention for ransom sa ilalim ng Article 267 ng Revised Penal Code.

Sinintensyahan sila ng parusang reclusion perpetua o hanggang 40 taon na pagkakakulong.

"It is all too apparent that the accused planned and premeditated to restrain Vhong Navarro to extort money from him. Proof of their agreement is inferred from their conduct before, during, and after the commission of the crime," saad ng korte.

Dagdag pa nito, ipinakita sa kanilang mga inasal na may “common understanding between them" sa paggawa ng krimen.

Agad ding kinansela ng korte ang piyansa ng mga akusado.

Sinabi ng legal counsel ni Navarro na si Atty. Alma Mallonga na sina Raz at Cornejo, na mga personal na dumalo sa proklamasyon, ay agad na “committed” ng korte.

"They asked for consideration. Ang sabi ng court, my ruling stands. And ang ruling ng court is for Ms. Cornejo and Mr. Simeon Raz who were there to already be committed," saad ni Mallonga sa interview.

"As far as Mr. Cedric Lee and Ferdinand Guerrero were concerned, they were ordered arrested and they will also be committed as soon as they are found," dagdag niya.

Inutusan din ng RTC ang mga akusado na bayaran si Navarro ng P100,000 dahil sa civil indemnity, P100,000 na moral damages, at P100,000 na exemplary damages.

“All monetary awards shall earn legal interest rate of 6% per annum from the finality of the judgment until fully paid,” anang korte.

Bagama't hindi dumalo si Navarro sa pagdinig, sinabi ng kaniyang legal counsel na si Atty. Alma Mallonga na tinatanggap ni Navarro ang desisyon.

Taong 2014 nang akusahan sina Lee at ang kaniyang grupo ng pagkulong kay Navarro at pagdulot ng serious physical injuries sa aktor.

Sa paghatol nito ng guilty kina Lee at sa kaniyang grupo, sinabi ng RTC na hindi pangkaraniwan na nagtipon ang mga akusado sa isang lugar kasama ang isang pulis ilang oras bago magkita sina Navarro at Cornejo.

Sinabi nito na unang itinago ng akusado na sa Ritz Towers ang kanilang tagpuan at binago ang kanilang mga testimonya matapos makita ang CCTV footage mula sa tore.

Dagdag pa ng korte, ang umano'y panggagahasa kay Cornejo ay bahagi rin ng kanilang plano.

Noong Marso 2023, ibinasura ng Korte Suprema ang mga kaso ng rape at acts of lasciviousness laban kay Navarro dahil sa kawalan ng probable cause.

"Deniece Cornejo lured Vhong Navarro to her condo unit so that his co-accused attained their purpose of restraining Vhong Navarro and later on extort money from Vhong before dropping the blotter," sabi ng RTC.

"Also her BDO bank account was seen in the text message of Cedric to Vhong, which [was] used where to send the extorted money," dagdag nito.

Bagama’t hindi dumalo si Navarro sa pagdinig, sinabi ni Atty. Bon Arcilla, isa sa mga abogado ni Navarro, na "very happy" ang aktor.

"He was very happy na this 10-year struggle is finally—has closure and that justice was served. We're very happy," sabi ni Arcilla.

Nang tanungin kung bakit hindi dumalo si Navarro sa pagdinig, sinabi ni Mallonga na batid ng aktor na magkakaroon ng promulgation ngunit hindi sila sigurado sa desisyon ng korte.

"Hindi din kasi kami sigurado kung anong mangyayari kahit na sabi ko panatag kami sa aming kaso (because we weren't sure what would happen even though I said we were confident about our case)," saad niya.

"So I think kahit na masayang-masaya si Mr. Vhong Navarro, hanggang ngayon naaalala niya yung paghihirap niya na nadanas, hindi lamang nu'ng [panahon na] the crime was committed against him, pero 'yung journey niya towards getting justice," dagdag ni Mallonga.

Sinabi ni Mallonga na naniniwala siyang aapela sa desisyon ng korte ang kabilang kampo.

Samantala, sinabi ng Bureau of Immigration (BI) na may aktibong hold departure order si Lee mula noong 2014 at isang aktibong warrant of arrest mula noong 2015. Nasa Immigration Lookout Bulletin (ILBO) din ang kaniyang pangalan mula noong 2014.

Sinabi pa ng BI na may standing warrant of arrest at nasa ILBO mula noong 2014 si Guerrero.

"The BI is committed to implement said orders if subjects are encountered in any ports of entry or exit," sabi ni Immigration spokesperson Dana Sandoval.  — RSJ/VAL, GMA Integrated News
