Inirekomenda ng Mandaluyong City Prosecutor's Office nitong Huwebes ang pagsasampa ng kasong of frustrated homicide sa halip na frustrated murder, laban sa driver na nakabundol sa isang security guard na nagmamando ng trapiko noong nakaraang Hunyo sa nabanggit na lungsod.

Sa limang-pahinang resolusyon na makikita sa post ni Mark Makalalad ng Super Radyo dzBB, sinabi ng piskalya na may sapat na basehan para isakdal sa korte ang suspek na si Jose Antonio Sanvicente.

“Anent the charge for violation of paragraph (2) of the Article 274 of the Revised Penal Code, this Office finds the same diametrically opposed if not incongruent, to the findings of frustrated homicide,” ayon sa resolusyon.

“Evidently, respondent’s intent to eliminate complainant negates any regard to save or aid his ailing victim,” dagdag nito.

Matatandaan na nagmamando ng trapiko noong Hunyo 6, ang biktimang si Christian Joseph Floralde sa panulukan ng Julia Vargas Avenue at St. Francis Street sa Mandaluyong, nang mabundol siya ng SUV na minamaneho ni Sanvicente.

Pero sa halip na tumigil para tulungan ang biktima, umarangkada palayo si Sanvicente.

Sa desisyon ng piskalya, ibinaba nito sa frustrated homicide ang isinampang kaso laban kay Sanvincente, mula sa mabigat na frustrated murder.

“While we do note that the crime may have been perpetrated with the use of a motor vehicle, the same does not necessarily qualify the offense to murder,” ayon sa resolusyon.

“The qualifying circumstance of ‘by means of a motor vehicle must pertain to an instance where the accused purposely sought or initially intended to commit a crime by employing such means. Such scenario, however, is utterly absent in the case at hand,” paliwanag pa nito.

Ibinasura naman ng piskalya dahil sa kakulangan ng ebidensiya ang reklamong abandonment of persons in danger and one’s own victim na isinampa rin laban sa suspek.
